On 7 June 2023, Ordinance No 155-B/2023 of 6 June entered into force, declaring the definitive installation of MENAC.
This diploma followed the entry into force of a set of legislative diplomas that regulated the installation of this entity, created with the entry into force, on 8 June 2022, of the General Regime for the Prevention of Corruption ("RGPC").
Since then, the human and material conditions necessary for the full functioning of MENAC have already been implemented, namely the establishment of the respective technical and administrative support staff map, the budget allocation to cover its operating expenses and the constitution of a large majority of its bodies (President, Vice-President, Advisory Board and Monitoring Committee) with only the constitution of the Sanctions Committee and the complete filling of the staff map being missing.
Taking these circumstances into account, the President of MENAC announced that he considers that the conditions for the full operation of the entity are already met, presenting the proposal to recognise its definitive installation, which was approved by the aforementioned Ordinance.
Despite the intention of the Portuguese Government to speed up the process of implementation of this entity, it is possible that MENAC will still take some time to be fully operational and able to monitor the compliance with the rules contained in the RGPC since its control body - the Sanctions Committee - has not yet been constituted.
